The seventh national conference on administrative adjudication was held at the National Judges College on Aug 29. Zhang Jun, president of the Supreme People's Court (SPC), attended the conference and delivered a speech.

It was noted at the conference that courts nationwide have made new progress in administrative adjudication since the previous conference, with stronger political foundations, more targeted efforts to serve the overall national interests, more powerful supervision and support, more effective dispute resolution, and more practical guidance.

The conference pointed out that the fourth plenary session of the 20th Central Committee of the Communist Party of China (CPC) outlined important arrangements for advancing the rule of law in government administration, placing greater responsibilities on administrative adjudication. In the new area, administrative adjudication faces new tasks and requirements, while challenges remain, including the overall growth of administrative litigation cases, the need to strengthen coordination in substantively resolving administrative disputes, and considerable room for improving the quality and efficiency of administrative adjudication, the conference noted.

The conference called for efforts to pursue fairness and justice in every judicial case, resolve administrative disputes through strict and impartial adjudication, protect people’s lawful rights and interests, and supervise administrative organs in exercising their functions and powers in accordance with the law, so as to promote the high-quality development of administrative adjudication.

The conference stressed that courts should strengthen political guidance, uphold a people-centered approach, supervise and correct unlawful administrative acts that violate people’s rights in accordance with the law, and properly handle the relationship between supervision and support. They should promote law-based administration through lawful, fair and impartial supervision, place greater emphasis on substantive resolution of administrative disputes, and identify common problems revealed by individual cases to promote improvements in law-based administration and social governance.

Courts should fully perform their functions in administrative adjudication to serve the overall national interests and the people, according to the conference. They should fully implement the case-filing registration system, provide explanations and guidance at the case-filing stage, and protect people’s lawful litigation rights. Courts should also support the development of the socialist market economy, help remove obstacles to the development of a unified national market, and foster a market-oriented, law-based and internationalized business environment.

Courts should support the building of a law-based government by promoting the establishment and improvement of the “3+N” working mechanism, and facilitate the application of standards established through administrative adjudication in administrative reconsideration and administrative law enforcement. They should work with administrative organs to better leverage administrative reconsideration as the primary channel for resolving administrative disputes. Courts should also strengthen the prevention and resolution of conflicts and disputes by promoting the integration of administrative dispute mediation centers into comprehensive governance centers, and making better use of information technology to help prevent and resolve administrative disputes in a timely and effective manner.

The conference stressed the need to coordinate reform, management and team building to ensure strict and impartial justice. Courts should steadily advance reform of the systems and mechanisms for administrative adjudication, explore differentiated handling of simple and complex administrative cases, and improve the quality, efficiency and effectiveness of administrative adjudication.

Courts should strengthen management, supervision and guidance of administrative adjudication, ensure that first-instance courts fulfill their responsibility of substantively resolving disputes and that higher-level courts exercise supervision and guidance, and implement systems requiring court and division heads to review cases and take the lead in handling cases. They should improve the political integrity, professional competence and professional ethics of administrative adjudication personnel, and strengthen discipline and conduct to uphold judicial impartiality.

Deng Xiuming, executive vice-president of the SPC, presided over the conference. Sun Zhenping, head of the SPC’s Political Department, read out a circular commending outstanding groups and individuals for their achievements in administrative adjudication.

Zhang Xueqiao, deputy prosecutor general of the Supreme People’s Procuratorate, and Hu Weilie, vice-minister of justice, attended the conference and delivered speeches.

Fu Xinping, president of the Jiangxi High People’s Court, and officials from local courts in Guangdong, Jiangsu, and Liaoning provinces, as well as representatives from the CPC Bazhong Municipal Committee in Sichuan province and the Sanyuan District People’s Government of Sanming city in Fujian province delivered speeches and shared their experiences.
