Guidelines issued to curb property crimes in waterborne logistics sector
The Supreme People's Court (SPC), the Supreme People's Procuratorate (SPP), and the Ministry of Public Security (MPS) jointly issued a set of guidelines on punishing property crimes in the waterborne logistics sector.
The document is formulated strictly in accordance with the Criminal Law, the Criminal Procedure Law, and relevant judicial interpretations. It makes comprehensive guidance regarding the application of the law and policy considerations for handling property crimes in this sector. It emphasizes punishing such crimes in accordance with the law, accurately implementing the criminal policy of tempering justice with mercy, and resolutely safeguarding the vital interests of the people.
Adopting a problem-oriented approach and based on the characteristics of property crime cases in the waterborne logistics sector, the guidelines set forth provisions on issues such as the application of typical charges, jurisdictional rules, evidence collection, asset valuation, and handling of case-related property, offering clear guidance for law enforcement and case handling in this field.
Additionally, the guidelines advocate for systematic governance by combining punishment and prevention. They put forward work requirements for promoting industrial governance and enhancing legal outreach and education as part of law enforcement efforts, emphasizing the improvement of long-term mechanisms to foster a sound legal and social environment for the high-quality development of waterborne logistics.
