SPC, MOJ release typical cases on enterprise-related administrative reconsideration and litigation

The Supreme People’s Court (SPC) and the Ministry of Justice released 10 typical cases of administrative reconsideration and litigation involving enterprises.

The move is part of broader efforts to implement the Private Sector Promotion Law, which took effect on May 20, and the Communist Party of China Central Committee’s decisions on advancing the private sector, and further regulate law enforcement and judicial practices concerning enterprises.

The selected cases cover various areas of administrative management and types of disputes. They highlight the fairness, efficiency and accessibility of administrative reconsideration system as well as the role of administrative litigation in supervising and supporting law-based administration. The cases are expected to serve as references for people’s courts and reconsideration institutions nationwide, help unify judicial standards, protect the legitimate rights and interests of private enterprises and entrepreneurs, and contribute to a fair and transparent business environment.

According to the SPC, courts and administrative reconsideration institutions will continue to strengthen the protection of the private economy through fair and impartial adjudication, promote strict and regulated law enforcement, and improve long-term mechanisms to provide stronger legal guarantees for the high-quality development of the private sector.
