SPC announces updated compensation standard for infringement of citizens' personal liberty
The Supreme People's Court (SPC) has issued a notice updating the standard of compensation for individuals whose personal liberty has been infringed, in accordance with the latest wage data released by the National Bureau of Statistics on May 16.
According to the data, the average annual salary of employees in urban non-private units in 2024 was 124,110 yuan ($17,240), with the average daily wage calculated at 475.52 yuan. In response to this update, the SPC issued the notice requiring that, effective May 19, 2025, compensation for infringements on personal freedom under the State Compensation Law will be determined according to this daily wage figure.
Article 33 of the State Compensation Law stipulates that compensation for infringement of a citizen’s personal liberty shall be calculated according to the average daily wage of employees in the preceding year. The SPC requires that, starting from May 19, 2025, courts at all levels must strictly adhere to this provision, along with Paragraph 2 of Article 21 in the judicial interpretation concerning the application of law in the handling of criminal compensation cases that was jointly issued by the SPC and the Supreme People's Procuratorate.
