SPC promotes Fengqiao Experience to prevent and resolve financial disputes
The Supreme People's Court (SPC) released new exemplary cases on Jan 14 regarding the construction of courts in the new era, as part of efforts to promote the prevention and resolution of loan contract disputes by learning from the “Fengqiao Experience”, a Chinese practice of grassroots dispute resolution featuring mediation. Two more batches of such cases will be released later.
By focusing on judicial functions and innovating adjudication modes, courts throughout the country are striving to promote diversified dispute resolutions to uphold the order of financial markets, with the development of the "Fengqiao Experience" highlighted.
The SPC initiated the selection and compilation of the exemplary cases through rigorous screening and recommendations from courts throughout the country as well as extensive solicitation of opinions and suggestions.
Typical experiences and practices promoting the prevention and resolution of loan contract disputes, especially those involving high-interest loans and professional lenders who frequently provide funds to unspecified individuals with the primary purpose of earning high interest, were selected.
These cases serve as valuable references for over 10,000 courts nationwide in effectively resolving loan contract disputes.
Courts at all levels are urged to fully implement the decisions and plans of the Communist Party of China Central Committee in upholding and developing the "Fengqiao Experience" in the new era, and study and draw experiences and lessons from the released exemplary cases to facilitate the resolution of loan contract disputes at the grassroots level and in the early stages, in a bid to promote the sound development of the financial market.
