The Supreme People’s Court held a judgment enforcement symposium in Nanjing to provide a communication and exchange platform for higher people’s courts nationwide, Jan 8-9.
Jiang Bixin, the vice-president of the Supreme People's Court, delivered a speech at the symposium, which was chaired by Liu Guixiang, director of the Judgment Enforcement Department of the top court and attended by heads of judgment enforcement bureaus.
Jiang said that as 2016 marks the beginning of China’s 13th Five-Year Plan (2016-2020), the courts’ judgment enforcement will become more essential and face tougher missions and stricter requirements in ensuring economic growth and social development. He urged all the courts to use innovative thinking to perform their duties in judgment enforcement and make sure that all legally effective judgments are fully implemented to maintain the authority of justice and the rule of law.
He gave suggestions on how to realize permanent effects, including creation of an environment of the rule of law, risk prevention, and establishment of a credit information system and mechanisms for insurance and bankruptcy.
Jiang also clarified specific measures on achieving results over the short term, such as regulating enforcement behavior, using an intelligent, united and coordinated restriction and punishment approach against those who refuse to comply with judgments, finding a more scientific mechanism for judgment enforcement, and building a more professional team.
To crack down on resisting, hindering, circumventing, or intervening to prevent judgment enforcement, unremitting efforts should be made to expose cases of such negative behavior, Jiang added.
He urged modernization of judgment enforcement through reform of and innovations to the present system mechanisms, organization of themed campaigns, relief for individuals subject to enforcement and in financial difficulty, and supervision.
In his speech, Jiang called for setting up an effective accountability mechanism to prevent inappropriate or excessive execution of court decisions.
