Shanghai court upholds Spanish executive’s rights in labor dispute

Pablo Fernandez, a Spanish executive who first arrived in China in 2009, has lived in Shanghai since 2015.

During his time in the city, Fernandez co-founded a company and served as its general manager and CEO for six years. When the company encountered cash flow issues, he deferred taking part of his own salary to help it through the tough times. However, in 2020, internal disputes between the founders and investors led to operational setbacks. Things took a worse turn in early 2023, when the company unilaterally terminated his contract and withheld over 800,000 yuan ($110,000) in unpaid wages.

Facing this difficult situation, Fernandez turned to the legal system for help—an intimidating step for a foreigner in a different country. To his surprise, the legal proceedings went more smoothly than he had expected. During adjudication at Shanghai First Intermediate People’s Court, judges upheld the principles of fair and equal protection for both foreign businesses and foreign employees working in China. They carefully examined the facts and delivered a judgment that safeguarded Fernandez’s legal rights. For him, the outcome was not only a relief but also a powerful testament to the fairness and efficiency of China’s judicial system.

Reflecting on his experience, Fernandez spoke highly of Shanghai’s openness and commitment to the rule of law. Over the years, he has witnessed the city’s rapid transformation—its booming economy, enhanced public security, growing innovation, deeper international engagement, and increasingly convenient daily life. These changes have deepened his emotional bond with Shanghai and strengthened his confidence in its future.

Regarding Shanghai as his “second hometown”, Fernandez said “whether as a regular employee or a business owner, I’ve found my place here. The integrity of China’s judicial system gives me peace of mind.”
