SPC discusses sample pleadings to enhance judicial efficiency

The Adjudication Committee of the Supreme People’s Court (SPC) convened a meeting to discuss the second batch of sample pleadings for complaints and responses, aimed at further streamlining legal proceedings and enhancing judicial efficiency. Zhang Jun, president of the SPC, presided over the meeting.

Since their introduction in March 2024, the sample pleadings have played an important role in safeguarding litigants' rights, facilitating public participation in legal proceedings, and improving the quality and efficiency of litigation and mediation since. The SPC, in collaboration with the Ministry of Justice and the All China Lawyers Association, launched these sample pleadings for adjudication use. 

Over the past year, courts throughout the country have actively promoted the use of sample pleadings through various means, including training sessions with local lawyers associations and experts, inviting litigants to share their user experience of the samples, and employing information technology to assist in drafting complaints and responses.

The utilization rate of sample pleadings has steadily increased, with some courts reporting adoption rates exceeding 70 percent in cases involving labor disputes, credit card disputes, financial loan contract disputes, among others. Some courts have even reported a 100 percent adoption rate for certain case types.

The use of such samples has significantly reduced the adjudication periods in cases involving property service contract disputes, private lending disputes, and motor vehicle traffic accident liability disputes by over 50 percent.

Courts nationwide have also been working to enhance litigation services by assisting litigants and lawyers in accurately completing complaints and responses to better protect litigants' rights.

In response to feedback from stakeholders and lessons learned during the adjudication use, the SPC has drafted the latest sample pleadings for 52 types of cases in nine areas, namely criminal, civil, administrative and commercial cases, intellectual property, maritime affairs, environment and resources, state compensation, and judgment enforcement.

The meeting emphasized the need to resolutely implement the case filing and registration system in order to protect citizens’ right to action.

Meeting participants also pledged to practice whole-process people’s democracy, actively seek feedback from various stakeholders, and continuously improve judicial services, so as to enhance the public’s sense of gain in judiciary.
