Shanghai court helps me preserve my ‘sweet business’, said Swiss entrepreneur

Werner Schuppisser, a Swiss entrepreneur, has lived and worked in Shanghai for over 20 years. Together with his business partner, he founded a company to bring a well-known Swiss ice cream brand to Shanghai.

However, this "sweet business" once faced a crisis. Disputes arose between Schuppisser and his partner over business management, leading his partner to file a series of lawsuits, seeking to dissolve the company and reclaim their investment.

"This company is like my baby. I couldn't bear to see the hard work of the past years destroyed, nor was I willing to just fire our staff," said Schuppisser.

Ji Lingling, chief judge of the commercial division of the Jing'an Primary People's Court in Shanghai, explained that during the adjudication, the collegial panel rendered decisions based on evidence, affirming the company’s lawful property rights while clearly settling the disputes about the company’s delusion with reference to previous experience. Through concerted efforts, the collegial panel eventually facilitated a settlement between the two parties that resolved the issues peacefully by transferring equity, preventing further disputes.

"The case came before the Jing'an court, who patiently organized meetings to negotiate, and they tried to solve the dispute in a friendly way many times. I finally bought my partner’s equity and saved the company, and the staff also didn’t lose the jobs," Schuppisser said.

Today, his company has expanded to cities like Chongqing, Shenzhen, and Beijing, steadily growing its business presence. "Through this litigation, I experienced firsthand the professionalism, impartiality, and efficiency of Shanghai’s judges. With their help, my company can continue to develop, and both our employees and customers feel reassured," he said.

To successfully resolve this ice cream case, the court skillfully balanced legal rigidity with Chinese judicial wisdom, producing an outcome as sweet as the product itself. 

As a foreign investor, Schuppisser deeply appreciates the increasing convenience of doing business and living in China. "We continue to invest in our company and expand our business, hire more local staff, and also bring new products from Switzerland to the Chinese market. I have full confidence in the Chinese market and hope to bring more and more flavors from Switzerland to China. I’ve always dreamed of running my own little 'sweet business,'" he said.
