Top court releases typical ruling enforcement cases involving wage arrears among migrant workers
On May 1, the Supreme People's Court (SPC) released 10 typical ruling enforcement cases involving wage arrears among migrant workers.
Various execution measures were employed in these cases, which serve as demonstrations and guidance to courts across the country in continuing to promote the ongoing efforts to eradicate wage arrears of migrant workers and safeguard their legitimate rights and interests.
Among the cases, some courts took multiple measures to enforce the rulings through negotiations and realized win-win results for both parties; some courts integrated the case into the restructuring procedure of the enterprise, which not only preserved the business value of the enterprise, but also quickly cashed the employees' wage claims and solved the enterprise's debt crisis. Some courts finished executing 10 rulings in nine days by searching asset clues via field investigations; and some courts optimized the allocation of auction funds through coordination with various units, prioritizing the timely disbursement of wages for migrant workers.
In recent years, courts in China have focused on solving the most pressing difficulties of high concern to the people, giving full play to judicial functions and intensifying efforts to enforce rulings involving wages of migrant workers. Special campaigns were launched nationwide, where 157,700 such rulings were enforced and concluded, involving sums amounting to 7.89 billion yuan ($1.14 billion).
Various measures were taken, including one-stop services, streamlining procedures, fully applying the three sets of rules for online litigation, mediation and operation, and operating both online and onsite for both local and cross-regional cases, which saved litigation costs and improved enforcement efficiency.
The online execution monitoring and control system was leveraged to reinforce online and offline asset investigation, and to comprehensively monitor and control property information of executed parties such as bank deposits, real estate, vehicles and equities. Penalties were increased against evasion and resistance to execution, and efforts were also made to coordinate with local departments to eradicate wage arrears of migrant workers. Meanwhile, various means of publicity, such as television, radio, newspapers, Weibo, WeChat and news apps, were deployed to foster a social atmosphere of punishing dishonesty and praising integrity.
