SPC’s role in facilitating national strategy

The Supreme People's Court (SPC) has offered its support to China's national strategies, such as the coordinated development of the Beijing-Tianjin-Hebei region and the planning and building of Xiong'an New Area in Hebei province. 

To provide high-quality judicial services for the region, officials at the SPC made survey trips to courts in the region so as to make detailed requirements and tailored measures.

The high people's courts of Beijing, Tianjin and Hebei have rolled out guideline documents and concrete actions to offer judicial services and guarantees for the strategy and to deepen the integration of judicial cooperation. 

Courts in Beijing properly handled a group of cases involving lease contract, labor dispute, demolition and resettlement, and enterprise merger and liquidation in the city's key projects, such as the construction of the Beijing Municipal Administrative Center and Daxing International Airport, with focus on relieving the city of its non-capital functions.

Tianjin courts have improved the trial mechanism for intellectual property, maritime, and financial cases, in a bid to help the city realize its goal of developing a national advanced manufacturing R&D base, a world-class low-carbon smart port, and a demonstration zone for financial innovation and operation.

Courts in Hebei have launched a work mechanism to guarantee the Xiong'an New Area's development and support the establishment of a center for administrative dispute resolution in the area.

In addition, courts in the region have strengthened their cooperation to unify judicial standards in cases involving the Beijing 2022 Winter Olympics, environmental resources, the Grand Canal protection, and bankruptcy, and helped address these issues with efficient services.

Due to the new challenges brought by the integrated development, a large number of legal disputes, especially cross-regional ones, inevitably arise. Courts in Beijing, Tianjin and Hebei have taken action to address these issues.

Early in 2016, the SPC issued Opinions on Providing Judicial Services and Safeguards for the Coordinated Development of Beijing-Tianjin-Hebei Region.

The document makes it clear that the contact mechanism should be improved among courts in the region. A group of measures will be implemented, such as setting up a joint conference mechanism, a coordinated system for judgment enforcement, and online property inquiry and control procedures.

The idea of building a centralized jurisdiction or specialized system for cases relating to intellectual property rights, maritime affairs, and ecological environment protection should also be explored, according to the document.

In October 2019, a similar document was issued for the planning and building of Xiong’an New Area. With its guidance, courts in the Beijing-Tianjin-Hebei region have intensified their efforts on protecting IP rights, ecology and the environment, as well as insisting on opening-up and strengthening foreign-related commercial trials.

Efforts have also been made to cultivate more judicial talents through exchange programs and to conduct joint theoretical research in recent years.

Thanks to the SPC's instruction on courts work in the region, a more convenient and efficient institutional mechanism has been set up to meet the needs in the integrated development of the Beijing-Tianjin-Hebei region.

Smart court construction has helped courts in Beijing, Tianjin and Hebei develop an intelligent case filing system. The coordination on judgment enforcement within the region began eight years ago, when the three high people's courts signed an agreement to make their measures more detailed.

Xiong'an New Area, covering Xiongxian, Rongcheng and Anxin counties in Hebei province, is about 100 km south of Beijing.
