Top court releases more typical civil cases promoting core socialist values
The Supreme People's Court (SPC) released ten typical civil cases promoting core socialist values on March 1, 2023.
This is the third such release, following the previous two in 2020 and 2022. These ten cases involve the following six areas:
- Protection of martyrs. Wrongdoings, such as treading on the base of martyrs' tombstones and posing for pictures irreverently in front of their tombstones, were punished with criminal or civil liabilities according to law.
- Goodwill persuasion. When personal injury occurred during an attempt to stop an action that was endangering the safety of a bus, the persuader was not liable for the injury, as the behavior was goodwill persuasion for the protection of public interest.
- Care for the elderly and minors. Bereaved elderly could visit their grandchildren. A package of solutions was provided to solve the problem of divorced couples jointly raising children while living in different places, which protected the benefit of the children to the greatest extent. Network service contracts that provided unhealthy content to minors were deemed invalid.
- Freedom of marriage. Children who are coerced into marriage by their parents may request an annulment according to law.
- Protection of workers. Victims of workplace sexual harassment can claim emotional damages against perpetrators. Workers have the right to refuse the employer to pay wages in virtual currency. When a worker asks for leave to take care of a parent who is critically ill, the employer should render kindness and tolerance.
- Highlighting rule of law. "Square dance" organizers are not at fault or liable for the sudden death of a volunteer dancer.
