SPC releases new guidance cases on labor protection
The Supreme People's Court (SPC) recently released seven guidance cases on the protection of labor rights as reference cases for local courts.
These cases, filed as group No.32 cases, involve areas such as determining labor relations between two parties by analyzing the nature of the contract signed by them as well as the relationship of rights and obligations reflected in the actual performance of the contract, detailing the criteria for defining the legitimacy of an employer's unilateral termination of labor contracts, and regulating the employment autonomy of employers with the principle of integrity, as well as employer's actions on sexual harassment prevention and handling, disputes related to year-end bonus, non-competition-related issues, and the equal right to employment.
