Top court intensifies judge supervision
The Supreme People's Court (SPC) has issued tentative provisions for the administration of judge delisting for disciplinary and law violations. The issuance of the provisions is a key measure in deepening the comprehensive reform of the judicial system and promoting rectification of court personnel.
It is of great significance for improving the punitive system for judges, constructing a clean and honest administration in the court system, and building a loyal and honest team of judges in the new era.
Maintaining the authority and integrity of judicial trials as the mainstay, the provisions integrate judicial system reform with the efforts for improving Party conduct and upholding integrity and establish a coordinating system aligning judges' violations of discipline and law with their personnel quota revocation.
The provisions are in sync with related national laws, Party regulations and personnel policies, such as China's law on public servants and judges, and aim to solve practical problems reported by local courts, including complicated cases of discipline and law violations and standard discrepancies in personnel quota revocations.
It is stated in the provisions that actual penalty should serve as the main standard and due consideration should be given to the reasons and circumstances of disciplinary and law violations in determining applicable personnel quota revocation policies, while local courts are allowed certain autonomy.
The provisions combine leniency with severity and provide different revocation situations for different degrees of violations. They are practicality-oriented with specifications on filing and review procedures. Follow-up measures are also provided that reinforce the feasibility of the revocation polices.
