SPC continues lectures on Civil Code
The Supreme People’s Court invited a law expert to give the second lecture on the Civil Code on July 10. The first lecture was given by Zhou Qiang, president of the SPC on June 29.
Sun Xianzhong, member of the Constitution and Law Committee of the National People’s Congress, was invited to lecture on the code’s importance and institutional and theoretical updates.
The Civil Code is fundamental to improving law-based governance and it should be understood precisely, said Sun.
To learn the code's whole system, people should understand the guiding ideology of the legislators who compiled it, consider its recognition and acceptance by the public and comprehend its scientific legaltheories and logic, he said.
Sun put forward six points judicial workers should understand to fully grasp the code's important provisions and theoretical updates. First, they should implement the code with a systematic mindset to be sure to comprehend its basic rules; second, they must focus on the protection of people's rights; third, it's important for them to pay attention to major advances in civil juristic act regulation; fourth, they must fully understand the innovations of the code on personal rights and make judgments in a precise way to protect those rights; fifth, they must accurately apply the code during the analysis of commercial transaction issues and in related judgments; and sixth, they should pay attention to the application of the code in protecting public property.
